1. Introduction
These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "User") and Bristle Busters ("Uhunt", "we", "us", or "our"), a business owned by Jesse Farr, with Australian Business Number (ABN) 81 307 063 904, located at 19 Hughes Road, Flinton QLD, 4427, Australia, regarding your access to and use of Uhunt.tv, including its mobile applications (iOS and Android) and web platform (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
Uhunt is a social network and premium video content platform for the outdoor community, including hunting, 4x4, fishing, and rural adventure users. It offers features like user profiles, social feeds, premium content subscriptions, creator channels, series streaming, classifieds, and location-based content filters. We are committed to providing a safe and compliant platform, adhering to all applicable laws and regulations.
2. Eligibility
- You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.
- Use of the Service is void where prohibited by law. You represent that you are not prohibited from using the Service under any applicable laws or regulations, including those restricting hunting-related content in your jurisdiction.
3. Account Registration
- To access certain features (e.g., posting content, subscribing to premium tiers, or using classifieds), you must register for an account. You agree to:
- Provide accurate, complete, and current information during registration.
- Keep your login credentials (e.g., username, password) confidential and not share them with others.
- Enable two-factor authentication (2FA), where available, to enhance account security.
- Notify us immediately at support@uhunt.tv of any unauthorized use of your account.
- You are solely responsible for all activities under your account, whether or not authorized by you.
- We may require identity verification for account recovery or dispute resolution.
- We may suspend, terminate, or restrict your account if we detect fraudulent activity, inactivity, or violations of these Terms, at our sole discretion.
4. Subscriptions and Payments
4.1 Subscription Tiers
- The Service offers multiple subscription tiers: Free, Premium, Plus, and Max, with access to premium content (e.g., exclusive shows, series, hunting documentaries) and features (e.g., creator channels, classified subscriptions) varying by tier.
- Users may also subscribe to individual creator channels via the Creator Market Program, supporting content creators directly.
4.2 Payment Processing
- Subscription fees are billed through the Apple App Store, Google Play Store, or secure third-party payment processors (e.g., Stripe, PayPal). All payments are subject to the respective provider’s terms and conditions.
- Subscriptions are auto-renewing and continue until cancelled. You may cancel at any time via your app store account settings, through the Uhunt app or website account settings, or by contacting support@uhunt.tv.
- Subscription changes (e.g., upgrading from Premium to Max) take effect at the next billing cycle unless otherwise specified.
- Uhunt may offer promotional discounts, subject to additional terms communicated at the time of the offer.
- Fees are charged in Australian Dollars (AUD) and may include GST where applicable, as required by Australian law.
4.3 Refund Policy
- Uhunt does not issue refunds for subscriptions or in-app purchases except as required by Australian Consumer Law or the policies of the Apple App Store or Google Play Store.
- If you believe you are entitled to a refund, contact support@uhunt.tv or your app store provider.
5. User Content and Conduct
5.1 User Content
- User Content includes all content you post, upload, or share on the Service, such as photos, videos, audio, comments, classifieds listings, or profile updates.
- You are solely responsible for your User Content and ensuring it complies with all applicable laws, including the Australian Copyright Act 1968, and does not:
- Infringe on third-party rights (e.g., copyrights, trademarks, privacy, publicity).
- Contain defamatory, obscene, pornographic, violent, or otherwise harmful material.
- Promote illegal activities, hate speech, or discrimination based on race, gender, religion, or other protected characteristics.
- Include malware, viruses, or fraudulent material.
- Depict illegal hunting practices (e.g., poaching) or unsafe firearm use.
- You are solely responsible for ensuring your User Content does not engage in misleading or deceptive conduct under Section 18 of the Australian Consumer Law. Uhunt is not liable for any claims or losses arising from such conduct by users.
- You retain ownership of your User Content but grant Uhunt a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content as necessary to operate the Service (e.g., to display posts, stream series, or promote classifieds). This license survives termination of your account to the extent needed for ongoing platform operations (e.g., archived public posts).
5.2 Content Creators
- If you are a Content Creator using Channels (dedicated content hubs) or Series (organized episodic content) to produce premium content (e.g., full-length episodes), your rights and obligations are governed by a separate creator agreement negotiated on a case-by-case basis, if such an agreement is in place. These agreements define content usage, distribution, monetization, and exclusivity terms. If no creator agreement is in place, you are bound by the standard conditions applicable to public users as outlined in Section 5.1.
- Content Creators are responsible for ensuring their content complies with these Terms, any applicable creator agreements, and all applicable laws, including the Australian Copyright Act 1968. Content Creators must disclose any sponsored content in compliance with advertising laws (e.g., Australian Competition and Consumer Commission guidelines). Content Creators are responsible for ensuring their premium content complies with consumer guarantees under the Australian Consumer Law (e.g., acceptable quality, fitness for purpose). Uhunt is not liable for any breaches of these guarantees by Content Creators.
- Uhunt is not liable for creator content violations.
5.3 Conduct
- You agree not to:
- Use the Service for unauthorized commercial solicitation (e.g., spam, pyramid schemes).
- Circumvent access controls, scrape data, or interfere with platform functionality.
- Harass, threaten, or impersonate other users.
- Post misleading or fraudulent content (e.g., false classifieds listings).
- We reserve the right to moderate, remove, or restrict any User Content or user accounts that violate these Terms, at our sole discretion, using automated tools or manual review.
6. Video and Photo Posting Guidelines
To ensure that Uhunt remains a responsible and respectful platform for the hunting community, all videos and photos posted on the Service must adhere to the following guidelines, which reflect ethical, legal, and community standards. These guidelines are particularly critical for hunting-related content, including pig dogging, to protect users, the platform, and the broader hunting community from legal and public scrutiny. All User Content must also comply with Section 5 (User Content and Conduct) and Section 7 (Community Guidelines).
6.1 General Principles
- Ethical and Respectful Content: As a platform for hunters, Uhunt encourages sharing the hunting lifestyle with pride. However, all content must be posted responsibly, considering potential viewing by non-hunters, including animal rights activists and the general public. Your posts reflect on the entire hunting community, so exercise care to maintain a positive image.
- Legal Compliance: All content must comply with applicable laws, including the Australian Animal Welfare Standards and Guidelines and local hunting regulations, to avoid charges of animal cruelty or other legal consequences.
- You must ensure your hunting content does not mislead viewers about compliance with animal welfare or hunting laws under the Australian Consumer Law. Uhunt is not liable for any claims arising from misleading or deceptive representations in your content.
- Content Moderation: Uhunt may remove or restrict content that violates these guidelines, at our sole discretion. If unsure whether content complies, do not post it, and contact support@uhunt.tv for guidance.
6.2 Specific Guidelines for Pig Dogging and Hunting Content
- Videos:
- No Mauling or Prolonged Holding: Do not post videos showing dogs mauling pigs, causing severe injury, or holding a pig for an extended period while people stand by. Such content may be interpreted as causing unnecessary suffering under animal welfare laws and can lead to legal action or harm the hunting community’s reputation.
- No Sticking or Bleeding Out: Videos depicting the sticking or bleeding out of animals are prohibited, as they are easily misinterpreted and provide no educational or community value. Humane dispatch is necessary but should not be shown.
- Mute Squealing: If a pig squeals while being held, mute the audio or overlay music to avoid distressing viewers. Squealing sounds can be traumatic and misinterpreted, negatively portraying ethical hunts.
- Photos and Videos:
- No Injured Dogs: Do not post images or videos of injured dogs, as this can upset viewers, harm the perception of dog hunting, and serve no constructive purpose. Keep such content private to respect the animals and community.
- No Illegal or Unethical Activity: Content must not show or suggest illegal or unethical practices, including:
- Catching and releasing pigs.
- Tormenting animals.
- Any behavior that could be seen as unlawful or cruel under applicable laws.
- Editing Recommendations:
- Before posting, edit your content to ensure compliance with these guidelines. Editing can prevent misinterpretation and protect the hunting community. We recommend using free tools like CapCut (available on iOS, Android, and desktop) to:
- Trim clips to remove sensitive footage (e.g., squealing, dispatch).
- Mute or replace audio with music.
- Blur or cut scenes that may be misinterpreted.
- Present your hunt in a clean, respectful manner.
- A brief edit can significantly reduce legal and reputational risks for you, your fellow hunters, and the platform.
- Before posting, edit your content to ensure compliance with these guidelines. Editing can prevent misinterpretation and protect the hunting community. We recommend using free tools like CapCut (available on iOS, Android, and desktop) to:
6.3 Enforcement
- Violations of these guidelines may result in content removal, warnings, temporary restrictions, or account suspension, as outlined in Section 7.2. Repeat or severe violations may lead to account termination.
- Users are encouraged to report non-compliant content using the in-app reporting feature or by emailing support@uhunt.tv, as described in Section 7.2.
6.4 Community Responsibility
- Your content impacts the future of hunting, particularly dog hunting, in Australia. By adhering to these guidelines, you help protect the rights and reputation of the hunting community. When in doubt, prioritize ethical and legal standards over sharing content that could be misinterpreted.
7. Community Guidelines
7.1 Standards
To maintain a safe and respectful community, all User Content and interactions must adhere to these Community Guidelines:
- Respect Intellectual Property: Do not post content that infringes copyrights, trademarks, or other rights, as per the Australian Copyright Act 1968 and global laws.
- No Harmful Content: Avoid content that is defamatory, obscene, pornographic, violent, or promotes hate speech or discrimination.
- Protect Privacy: Do not share unauthorized personal information or images of others.
- Be Honest: Do not post fraudulent, misleading, or deceptive content, including in classifieds or promotions.
- Safe Technology: Do not upload malware, viruses, or harmful code.
- We encourage you to review these guidelines regularly, as they may be updated to reflect community standards.
7.2 Reporting Violations
- If you encounter content violating these guidelines, use the in-app reporting feature or email support@uhunt.tv with:
- The content’s location (e.g., URL, content ID).
- A description of the violation.
- We review reports promptly and may issue content warnings, impose temporary restrictions, or remove content and suspend accounts that violate these guidelines.
8. Child Safety
To ensure a safe environment for minors, Uhunt.tv implements specific measures to protect children from inappropriate content and interactions, particularly given the platform’s focus on hunting and outdoor activities. These measures comply with the Australian Online Safety Act 2021, Australian Privacy Act 1988, General Data Protection Regulation (GDPR), California Consumer Privacy Act (CCPA), Personal Information Protection and Electronic Documents Act (PIPEDA), and Apple/Google App Store guidelines. All users must adhere to these child safety requirements, which supplement Sections 2 (Eligibility), 5 (User Content and Conduct), 6 (Video and Photo Posting Guidelines), and 7 (Community Guidelines).
8.1 Age Restrictions
- Minimum Age: The Service is not directed at children under 13 years of age. Users under 13 are prohibited from registering for an account or using the Service. If we detect an account belonging to a user under 13, we will terminate it and delete any associated data, as outlined in Section 9 of our Privacy Policy.
- Users Aged 13-17: Users aged 13 to 17 may use the Service only with the express consent of a parent or legal guardian, who must agree to these Terms on their behalf, as specified in Section 2. Parents or guardians are responsible for supervising their child’s use of the Service.
- Age Verification: We may require users to verify their age to ensure compliance with this policy. Failure to provide satisfactory verification may result in account suspension or termination, at our sole discretion.
8.2 Content Protections
- Content Standards: All User Content must comply with Sections 6 (Video and Photo Posting Guidelines) and 7 (Community Guidelines), which prohibit material harmful to minors, including graphic hunting depictions (e.g., mauling, sticking, squealing), explicit or violent content, and illegal activities. Content creators must ensure premium content (e.g., Channels, Series) is age-appropriate, as per Section 5.2.
- Moderation Processes: We use automated tools and manual reviews to monitor and filter content, promptly removing material that violates our guidelines or poses risks to minors. Content flagged as inappropriate for users aged 13-17 (e.g., graphic hunting videos) may be restricted with age-based warnings or removed, as determined by our moderation team.
- Hunting Content Safeguards: To address the platform’s hunting focus, we implement specific protections, such as age-based content restrictions and warnings for videos depicting sensitive practices (e.g., pig dogging), ensuring compliance with the Online Safety Act 2021 and Apple/Google App Store Guideline 5.1.4.
8.3 Parental Controls and Support
- Parental Oversight: Parents or guardians of users aged 13-17 must provide consent and are encouraged to supervise their child’s account activity. We offer tools to review account details, posted content, and interactions, accessible upon request.
- Parental Requests: Parents may contact support@uhunt.tv to:
- Request account reviews or content restrictions (e.g., limiting exposure to hunting videos).
- Terminate their child’s account or delete associated data, subject to identity verification.
- Guidance for Parents: We provide resources on safe platform use for minors, available on our website or via support@uhunt.tv, to support informed supervision and compliance with GDPR Article 24 and Online Safety Act 2021.
8.4 Reporting and Response
- Reporting Tools: Users, including minors and their guardians, may report content or interactions posing safety risks to minors using the in-app reporting feature or by emailing support@uhunt.tv, as detailed in Section 7.2. Reports are prioritized and reviewed within 48 hours to ensure swift action.
- Safety Complaints: For urgent child safety concerns, contact our Child Safety Officer at support@uhunt.tv. We may remove content, suspend accounts, or refer issues to authorities, in accordance with the Online Safety Act 2021 and Apple/Google App Store guidelines.
- Transparency: We publish periodic transparency reports on child safety actions, including content moderation and account sanctions, available on our website, to maintain accountability under Australian Privacy Act 1988 (APP 1) and GDPR Article 12.
8.5 User Responsibilities and Liability
- Compliance Obligation: All users, including parents or guardians, must comply with this child safety section and related provisions (Sections 2, 5, 6, 7). Users are responsible for ensuring their content does not harm minors, particularly in hunting-related posts, and violations may result in account sanctions, as per Section 7.2.
- No Liability for Unauthorized Access: Uhunt is not liable for unauthorized access by children under 13 or for user content violating this policy, provided we take reasonable steps to address such issues upon notification, as per Section 13 (Disclaimers and Limitation of Liability).
- Indemnification: Users agree to indemnify Uhunt against claims, damages, or losses arising from their content or actions affecting child safety, as specified in Section 14 (Indemnification).
8.6 Compliance with Legal Requirements
- Australian Online Safety Act 2021: We comply with requirements to protect minors, including age restrictions, content moderation, and reporting mechanisms, as mandated by Sections 13 and 46, and cooperate with the eSafety Commissioner.
- GDPR, CCPA, PIPEDA: We ensure age-appropriate data processing and parental consent for users aged 13-17, aligning with GDPR Article 8, CCPA, and PIPEDA, as per Section 9 of our Privacy Policy.
- Apple/Google App Store Guidelines: We adhere to Guideline 5.1.4 and Google Play Families Policy through content safeguards, parental controls, and reporting tools, as outlined in Section 15 (App Store Compliance).
9. DMCA Takedown Requests
If you believe your copyright or other intellectual property rights have been infringed by content on Uhunt, you may submit a takedown request. Email support@uhunt.tv with:
- Your name, address, phone number, and email address.
- A description of the copyrighted work or intellectual property you claim has been infringed.
- The specific location (e.g., URL or content ID) of the allegedly infringing content on Uhunt.
- A statement that you have a good-faith belief the use is not authorized by the rights owner, their agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights owner or authorized to act on their behalf.
- Your electronic or physical signature.
We will review your request within 7 business days and may remove the content if it violates our policies or applicable laws, including the Australian Copyright Act 1968. Repeat infringers may face account suspension. You may submit a counter-notice if you believe content was removed in error, following the same process. For non-copyright issues (e.g., trademarks, defamation), contact support@uhunt.tv with similar details. We may forward your notice to the user who posted the content.
10. Intellectual Property
- Uhunt’s IP: All Uhunt trademarks, branding, logos, software, and content (excluding User Content) are the intellectual property of Bristle Busters or its licensors. You may not use, reproduce, or distribute Uhunt’s IP without prior written permission. You may not use Uhunt’s branding in a way that implies endorsement or affiliation without our explicit consent.
- User License: Subject to your compliance with these Terms, Uhunt grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include rights to modify, distribute, or reverse-engineer the Service.
11. Third-Party Services
- The Service integrates with third-party services, such as:
- Apple and Google for in-app purchases and social logins.
- Stripe and PayPal for payment processing.
- Firebase and Google Analytics for analytics.
- Meta and Google Ads for advertising.
- Your use of third-party services is governed by their respective terms and privacy policies (e.g., Apple Privacy Policy, Google Privacy Policy). Uhunt is not liable for the acts, omissions, or policies of third-party providers.
- The Service may include links to third-party websites or content (e.g., YouTube videos, branded gear promotions). Such content is subject to external terms and may change or become unavailable beyond Uhunt’s control. Uhunt does not endorse or control such content and is not liable for its accuracy or availability.
12. Classifieds and Marketplace
- The Service includes classifieds for gear and service promotion, accessible via subscriptions or free tiers, depending on your account level.
- You are responsible for ensuring classifieds listings are accurate, lawful, and comply with these Terms and all applicable laws, including local export/import regulations for hunting gear. Prohibited listings include:
- Weapons, ammunition, explosives, or weapon-related accessories (e.g., firearms, knives, grenades, or components designed for use in weapons), as restricted by Apple App Store Guidelines and applicable laws.
- Items that are illegal, unsafe, or promote harmful activities.
- Fraudulent or misleading listings.
- Uhunt does not guarantee the quality, safety, or legality of listed items or services. We may remove listings that violate these Terms or applicable laws, at our sole discretion. Uhunt may request verification for high-value listings to ensure compliance.
- Uhunt is not responsible for ensuring classifieds transactions comply with consumer guarantees under the Australian Consumer Law (e.g., acceptable quality, fitness for purpose). Users are independent parties in these transactions, and Uhunt is not liable for breaches of such guarantees.
- Transactions through classifieds are between you and the other party. Uhunt is not a party to these transactions and is not liable for disputes, losses, or damages arising from them. For issues with listings, contact support@uhunt.tv.
13. Termination
- By You: You may stop using the Service at any time by deleting your account via in-app settings or contacting support@uhunt.tv.
- By Uhunt: We may suspend or terminate your access to the Service, in whole or in part, if you:
- Breach these Terms or creator agreements.
- Misuse the Service (e.g., posting illegal content, abusing features).
- Engage in fraudulent or harmful activities.
- For operational, legal, or security reasons, at our sole discretion.
- Effects of Termination: Upon termination:
- Your license to use the Service ends.
- We may remove or retain your User Content as needed for legal or operational purposes (e.g., archived public posts).
- Any accrued rights or obligations (e.g., payments owed, indemnification) survive termination.
- Where feasible, we will notify you of the reasons for termination and provide an opportunity to appeal suspensions by contacting support@uhunt.tv.
14. Disclaimers and Limitation of Liability
- As-Is Basis: The Service is provided on an "as-is" and "as-available" basis. Uhunt does not guarantee that the Service will be uninterrupted, error-free, secure, or free from viruses or harmful components.
- No Warranties: To the extent permitted by law, Uhunt disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Liability Limitation: To the extent permitted by law:
- To the extent permitted by law, Uhunt is not liable for any breaches of obligations under the Australian Consumer Law by users, including misleading or deceptive conduct or failure to meet consumer guarantees, except where Uhunt is explicitly required to assume such liability by law.
- Uhunt is not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the Service.
- Uhunt is not liable for any injuries, damages, or losses resulting from outdoor activities (e.g., hunting, fishing) depicted or inspired by the Service.
- Our total liability is limited to the amount you paid to use the Service (if any) in the 12 months prior to the claim.
- Australian Consumer Law: Nothing in these Terms excludes or limits rights or remedies you may have under Australian Consumer Law (e.g., guarantees of acceptable quality) or other applicable laws that cannot be excluded.
- User Content Risks: Uhunt is not liable for any damages or losses arising from User Content, including content posted by others that you find objectionable or harmful.
15. Indemnification
You agree to indemnify, defend, and hold harmless Uhunt, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from:
- Your use of the Service.
- Your User Content or conduct, including violations of third-party rights or laws, or third-party intellectual property disputes arising from your content.
- Your breach of these Terms or creator agreements.
- Disputes arising from classifieds transactions or interactions with other users.
- Any claims or liabilities arising from your breach of the Australian Consumer Law, including misleading or deceptive conduct or failure to meet consumer guarantees.
16. App Store Compliance
- These Terms are between you and Uhunt, not Apple or Google. However:
- Apple and Google are third-party beneficiaries of these Terms and may enforce them.
- You must comply with the Apple App Store Terms of Service and Google Play Terms of Service.
- In case of conflict, app store terms may take precedence for app-specific features (e.g., in-app purchases).
- Uhunt, not Apple or Google, is responsible for the Service, its content, and any claims related to its use, subject to these Terms.
- Apple and Google have no obligation to provide maintenance or support for the Service.
- For app-related issues (e.g., bugs, crashes), contact Uhunt at support@uhunt.tv, not Apple or Google.
17. Changes to the Terms
- We may update these Terms from time to time to reflect changes in the Service, legal requirements, or operational needs.
- If we make material changes, we will notify you via the Service (e.g., in-app notifications) or email to support@uhunt.tv. Non-material changes (e.g., minor clarifications) may not require notification. Changes take effect upon posting unless otherwise specified.
- The latest version of these Terms is available at https://uhunt.tv/terms/terms.
- Your continued use of the Service after changes constitutes acceptance of the revised Terms. If you do not agree, stop using the Service.
18. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by the laws of Queensland, Australia, without regard to conflict of law principles.
- Dispute Resolution:
- You agree to first attempt to resolve disputes through good-faith negotiations by contacting support@uhunt.tv.
- If mutually agreed, disputes may be submitted to alternative dispute resolution (e.g., mediation) before court proceedings.
- If unresolved after 30 days, disputes may be submitted to the courts of Queensland, Australia, which have exclusive jurisdiction.
- Claims arising under the Australian Consumer Law may be submitted to Australian courts with consumer jurisdiction, as required by law.
- Class Action Waiver: You agree to resolve disputes on an individual basis and waive any right to participate in class actions or collective proceedings.
19. Miscellaneous
- Entire Agreement: These Terms, the Privacy Policy, and any creator agreements constitute the entire agreement between you and Uhunt, superseding prior agreements.
- Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.
- No Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
- Assignment: You may not assign these Terms without our prior written consent. Uhunt may assign these Terms to affiliates or successors without notice.
- Force Majeure: Uhunt is not liable for delays or failures due to events beyond our control (e.g., natural disasters, cyberattacks).
- Headings: Headings are for convenience and do not affect the interpretation of these Terms.
